EACC nets back Sh67 million in treasury fraud case

The Ethics and Anti-Corruption Commission (EACC) has secured a major court victory, recovering over Kes 67 million irregularly paid to Faith Jematia Kiptis, an officer at the National Treasury and Planning.

Faith Jematia Kiptis will be forced to refund a total of KES67 million, which she irregularly received as payment from the National Treasury.

This follows a court ruling in which, the Treasury officer was found guilty of getting public funds disguised as "taskforce, facilitation, entertainment, extraneous, and other allowances."

On Tuesday, Mr Justice Musyoki of the Anti-Corruption and Economic Crimes Division of the High Court noted that Jematia received these payments without prior approval of the Salaries and Remuneration Commission (SRC).

Jematia will now be forced to forfeit cash balances of KES2.44 million and KES6.32 million held in her Equity and KCB bank accounts respectively. 

Additionally, the court ordered that the Treasury official will be forced to pay interest on the amount until the entire KES67.67 million is fully recovered. 

In their suit, the Ethics and Anti-Corruption Commission (EACC) revealed that between January 2020 and June 2022, Jematia received "overlapping and unjustified allowances not recognized in public service guidelines."

"These included payments beyond her job group and allowances not sanctioned by the Salaries and Remuneration Commission (SRC)," EACC explained in an update.

This recovery is part of a broader EACC effort that has seen over KES174 million reclaimed from Treasury officials involved in similar fraudulent schemes.
